Terms of Service

1. Acceptance of Terms

By accessing or using Bruhsome ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Bruhsome is a collaborative celebration platform that allows users to create digital scrapbooks by collecting wishes, photos, videos, voice notes, and other media from friends and family. The Service includes free and paid tiers (Epic and Legendary plans).

3. User Accounts

• You must be at least 13 years old to use the Service
• You are responsible for maintaining the security of your account
• You are responsible for all activity under your account
• One person or entity may not maintain more than one account

4. User Content

4.1 Ownership

You retain ownership of content you submit to the Service. By submitting content, you grant Bruhsome a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content as necessary to provide the Service (e.g., displaying wishes in scrapbooks, generating exports).

4.2 Content Guidelines

You agree not to submit content that:

• Is illegal, harmful, threatening, abusive, harassing, or defamatory
• Infringes on intellectual property rights of others
• Contains malware, viruses, or harmful code
• Is sexually explicit or pornographic
• Promotes discrimination, hate speech, or violence
• Contains personal information of others without their consent

4.3 Content Moderation

We reserve the right to remove any content that violates these terms. Occasion organizers can also delete individual wishes from their occasions.

5. Contributor Terms

Contributors (people who add wishes) do not need an account. By contributing, they agree that their wish content will be visible to the occasion organizer and, upon reveal, to the recipient and potentially others with access to the scrapbook link.

6. Payments & Refunds

6.1 Pricing

The Service offers three tiers: Free, Epic ($14.99), and Legendary ($29.99). All payments are one-time per occasion. Prices may change with notice.

6.2 Refunds

Since the Service delivers digital goods upon payment, refunds are available within 7 days of purchase if the occasion has not been revealed. Once a scrapbook is revealed, no refund is available. Contact support@bruhsome.com for refund requests.

7. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance that temporarily disrupts the Service. We are not liable for any loss resulting from service interruptions.

8. Intellectual Property

The Bruhsome name, logo, design, and codebase are the property of Bruhsome. You may not copy, modify, or reverse-engineer the Service. The scrapbook themes, animations, and UI components are proprietary.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRUHSOME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PRECEDING 12 MONTHS.

10. Indemnification

You agree to indemnify and hold harmless Bruhsome from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

We may suspend or terminate your account for violations of these Terms. You may delete your account at any time. Upon termination, your data will be deleted within 30 days, except as required by law.

12. Governing Law

These Terms are governed by the laws of the State of Delaware, United States. Any disputes shall be resolved in the courts of Delaware.

13. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms.
